  3. We currently consider Pokémon products in English and Japanese. Other brands, languages or products may be considered at our discretion.
  4. We are not obliged to make an offer for any item submitted to us.
  5. We may refuse to deal with any seller where we reasonably believe the seller is under 18, acting without authority, providing false information or submitting items that are suspicious, counterfeit, stolen, altered, resealed, misdescribed or otherwise unsuitable.

Graded Cards

  1. We may consider cards graded by recognised grading companies, including PSA and Ace Grading.
  2. Other grading companies may be accepted or rejected at our discretion.
  3. Graded cards may be checked for authenticity, grade, certification number, label details, slab condition, scratches, cracks, tampering, incorrect labels, market demand and any other issue that may affect value or resale.

Raw Cards

  1. Raw cards are ungraded cards and are appraised based on condition, authenticity, rarity, language, set, edition, demand, market value and resale potential.
  2. Raw cards may be checked for whitening, dents, creases, bends, scratches, surface wear, print lines, edge wear, corner wear, water damage, ink marks, fading, warping, alterations and any other issue that may affect value.
  3. Any quote for raw cards before physical inspection is an estimate only and may change after we inspect the cards in person.

Sealed Products

  1. Sealed products are appraised based on product type, condition, authenticity, language, set, demand, market value, availability and resale potential.
  2. Sealed products may be checked for damaged packaging, crushed boxes, torn shrink wrap, loose shrink wrap, missing seals, broken seals, holes, water damage, sun damage, resealing, tampering, counterfeit packaging, incorrect contents, suspicious provenance or any other issue that may affect authenticity, value or resale.
  3. Any quote for sealed products before physical inspection is an estimate only and may change after we inspect the products in person.

Seller Confirmation

  1. By submitting items to us, you confirm that:

You are the legal owner of the items.
You have the right to sell the items.
The items are genuine.
The items are not stolen.
The items are not counterfeit.
The items are not knowingly altered, resealed, tampered with or misdescribed.
The items are not subject to finance, ownership dispute, charge, lien or any third-party claim.
The information you provide to us is accurate and complete.

  1. We may request proof of identity, proof of address, proof of purchase, invoices, receipts, additional photographs, videos, grading certificate details or other information reasonably required to verify the items or the seller.
  2. If you do not provide requested information, we may refuse to make an offer, cancel a quote, reject the items or return the items at your cost.

Appraisal and Pricing

  1. Items will be appraised based on our assessment of condition, authenticity, market value, resale value, demand, risk, fees, stock levels and business requirements.
  2. Cash offers and store credit offers may differ. Store credit offers may be higher than cash offers, but this is not guaranteed.
  3. Due to market movement, demand, availability and condition differences, the same item may receive different quotes at different times.
  4. Any pricing ranges shown on our website, forms, emails, adverts or social media are estimates only and do not guarantee a final offer.

Quote Process and Validity

  1. We aim to respond to quote requests within 2 business days. Larger collections, high-value submissions, sealed products or busy periods may require additional time.
  2. Unless stated otherwise, a quote is valid for 7 calendar days from the date it is issued.
  3. Items must be dispatched to us within the 7-day quote window unless we agree otherwise in writing.
  4. If items are dispatched after the quote has expired, we may carry out a new appraisal and issue a revised offer.
  5. A quote is not a final agreement to purchase until we have received, inspected and approved the items.

Inspection and Approval

  1. Once received, items will be inspected by our team. We aim to inspect and approve or reject items within 2 business days, although larger collections or items requiring further checks may take longer.
  2. Receipt of items by us does not mean the items have been accepted or purchased.
  3. We may reject, re-appraise or refuse to purchase any item that does not match the original submission or that we reasonably believe to be counterfeit, altered, resealed, tampered with, damaged, stolen, suspicious, misdescribed or unsuitable for resale.
  4. Our appraisal decision is final.

Shipping to Us

  1. You are responsible for arranging and paying for shipping to us unless we agree otherwise in writing.
  2. You are responsible for packaging items securely and safely.
  3. We recommend using a tracked, insured and signed-for delivery service.
  4. Risk in the items remains with you while the items are in transit to us.
  5. We are not responsible for items lost, damaged, delayed, misdelivered or stolen while in transit to us.

Rejected Items and Returns

  1. If we reject items or you reject a revised offer, you are responsible for arranging and paying for return postage or collection unless we agree otherwise in writing.
  2. We may require payment for return postage before releasing rejected items.
  3. We are not responsible for changes in market value while items are being returned.
  4. If you do not arrange collection, provide return postage payment or respond to us within a reasonable time, we may charge reasonable storage costs.

Payment and Ownership

  1. Payment will usually be made by bank transfer, PayPal or store credit.
  2. Payment is usually made on the same working day that the final appraisal is approved, although payment times may vary due to bank processing times, payment provider delays, verification checks, weekends, bank holidays or circumstances outside our control.
  3. You are responsible for providing accurate payment details.
  4. We are not responsible for payment delays, failed payments or lost payments caused by incorrect PayPal, bank, account or payment details provided by you.
  5. Ownership of accepted items transfers to OBSIDIA GROUP (UK) LTD once payment has been issued to you or store credit has been issued to your account.
  6. Once payment or store credit has been issued, the sale is final unless we agree otherwise in writing.

Suspicious, Counterfeit or Stolen Items

  1. We may reject, hold, return or refuse to purchase any item we reasonably believe to be counterfeit, altered, tampered with, resealed, stolen, suspicious, misdescribed or otherwise unsuitable.
  2. Where we reasonably believe items may be stolen, counterfeit, fraudulent or unlawful, we may report the matter to the relevant authorities or take any other action reasonably necessary to protect our business, customers and legal position.

General

  1. We may withdraw, refuse or revise an offer at any time before payment or store credit has been issued.
  2. We may stop accepting certain brands, products, languages, grading companies, sealed products or categories at any time.
  3. You are responsible for any tax, reporting, accounting or other obligations that may apply to your sale of items to us.
  4. We may update these Terms at any time. The latest version will apply to new submissions from the date it is published on our website or otherwise made available.

Liability and Disputes

  1. We are not liable for loss, damage, delay, reduction in value, market movement, postage costs, courier issues, payment provider delays or any other loss except where caused by our negligence or where liability cannot be excluded by law.
  2. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be limited or excluded.
  3. These Terms are governed by the laws of England and Wales.
  4. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
